(ii) declares that the representative is responsible for the compensation of the person under the system; and reparation means a payment to be paid in accordance with paragraphs 48 or 60. (3) However, the finding under Article 29 that an institution is responsible for the misuse of a person and is therefore required to remedy it may have the effect of imposing on the institution a civil law obligation to make payments under the system in respect of that remedy. A person may only lodge an application for appeal under the system. Whether the application is successful or unsuccessful, the person cannot make another application for recourse under the system (unless the person withdraws the application before the operator decides whether it should be approved or not).
